The Supreme Court has dismissed John Mahama’s application for stay of proceedings.
Mahama filed the application through his lawyers, following the dismissal of his application for interrogatories.
He wants the hearing of the substantive case paused until his review application was determined.
In its ruling on Tuesday the seven-member panel presided over by the Chief Justice Anin Yeboah announced that the motion has been struck.
This was after counsel for the petitioner Tsatsu Tsikata moved the motion regarding the stay of proceedings it had filed on January 21, 2021.
It was the case of the court that once the petitioner has already filed it witness statements for the hearing to continue, the application for stay will no longer hold.
Mahama on Wednesday, December 30, 2020, filed a petition before the Supreme Court to challenge the outcome of the presidential race. According to him, the election was rigged in favour of President Nana Akufo-Addo. Akufo-Addo defeated Mahama in the election to secure another four-year term; collecting 51.302% of the votes cast against the latter’s 47.359%.
